1. Acceptance of Terms
By accessing or using Uncloak’s services, users agree to be bound by these Terms of Service and the incorporated Data Processing Agreement (“DPA”). If you do not agree, do not use our platform.
2. Services Provided
Uncloak offers analytics and social intelligence tools for Twitch streamers, brands, agencies, and gaming publishers.
3. User Accounts
Users must provide accurate and complete information during registration.
Users are responsible for maintaining account security and confidentiality.
Unauthorized use must be reported immediately.
4. Payment and Billing
Subscription fees may be billed monthly, quarterly, or annually, depending on the selected plan.
Payments are processed securely via Stripe; Uncloak does not store payment card data.
Fees are non-refundable except as specified under the Refund Policy.
Subscriptions renew automatically unless cancelled prior to the next billing cycle.
5. Refund and Cancellation Policies
Refund Policy
All subscription fees are non-refundable except when Uncloak terminates the service without cause or fails to provide access due to technical issues.
Refund requests must be submitted within 30 days of the charge date at support@uncloak.co.
Approved refunds will be processed to the original payment method.
Cancellation Policy
Users may cancel their subscription at any time through their account dashboard or by contacting support.
Cancellations take effect at the end of the current billing cycle. Access to paid features continues until the subscription expiry date.
Uncloak may suspend or terminate user accounts that violate these Terms or misuse the platform.
6. Intellectual Property
Uncloak and its licensors retain all rights, title, and interest in and to the platform, software, analytics tools, and related intellectual property.
Users are granted a limited, non-exclusive, non-transferable license to access and use the services solely for their business purposes.
Analytics outputs generated by the platform remain Uncloak’s intellectual property.
Uncloak collects Twitch chat messages only for anonymized, aggregated marketing insights; these messages are never individually identifiable.
Uncloak does not claim ownership over any customer or third-party data obtained through APIs like Twitch or IGDB.
7. Disclaimer of Warranties
Uncloak provides the platform and services “as is” and “as available” without any express or implied warranties.
Uncloak does not guarantee continuous, uninterrupted, or error-free operation.
Users assume all risks associated with use.
All warranties of merchantability, fitness for a particular purpose, or non-infringement are disclaimed to the fullest extent permitted by law.
8. Limitation of Liability
To the maximum extent permitted by law, Uncloak and its affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages.
Uncloak’s total liability shall not exceed the total subscription fees paid in the twelve (12) months prior to a claim.
Liability for fraud, willful misconduct, or death or injury caused by negligence is not limited.
9. Termination
Either party may terminate the agreement with written notice.
Upon termination, access to services ceases immediately, though outstanding fees remain payable.
Uncloak may suspend or terminate accounts violating these Terms without prior notice.
All Twitch data collected is deleted or returned as required by Twitch API terms and applicable law.
10. Governing Law and Dispute Resolution
These Terms are governed by the laws of Singapore.
Disputes will be resolved via negotiation or, failing that, arbitration or court proceedings in Singapore.
Users submit to the exclusive jurisdiction of Singapore courts.
11. Changes to Terms
Uncloak may amend these Terms at any time.
Material updates will be communicated via platform notices or email.
Continued use of the platform constitutes acceptance of the revised Terms.

Annex: Data Processing Agreement (DPA)
This Data Processing Agreement (“DPA”) forms part of the agreement between Uncloak Pte. Ltd. (“Processor”) and its customer (“Controller”) regarding the processing of personal data in connection with Uncloak’s services.
1. Roles and Responsibilities
Controller: Determines the purpose and means of processing personal data.
Processor: Uncloak processes personal data on behalf of the Controller and only as directed under this DPA and the main Terms of Service.
2. Subject Matter and Duration
The Processor handles personal data as necessary for delivering Uncloak services.
This DPA remains in effect for as long as Uncloak processes personal data on the Controller’s behalf.
3. Nature and Purpose of Processing
Uncloak processes Customer Data to manage accounts, subscriptions, and billing.
Public Twitch API data (e.g., anonymized chat messages, channel metadata) is processed for aggregated analytic insights only.
No private Twitch user data is stored, and all processing complies with Twitch’s Developer Agreement.
4. Types of Personal Data and Categories of Data Subjects
Personal Data: Customer registration details, user contact info, and payment information.
Public Data: Public Twitch metadata, anonymized chat logs.
Data Subjects: Customer users, employees, and Twitch users dependent on public data.
5. Obligations of the Processor
Uncloak commits to:
Process data solely on documented instructions from the Controller.
Maintain security through appropriate technical and organizational measures.
Assist the Controller in fulfilling data subject rights and breach obligations.
Comply with all applicable data protection laws, including GDPR and Singapore’s PDPA.
6. Subprocessors
Uncloak may engage trusted subprocessors for operations, including:
Stripe – payment processing
Microsoft Azure – hosting and infrastructure
PostHog – analytics
Intercom – messaging and support services
Uncloak ensures each subprocessor adheres to comparable privacy and security standards.
7. Data Transfers
Any transfer of personal data outside Singapore or the EU will be protected using Standard Contractual Clauses or equivalent safeguards to ensure data protection continuity.
8. Data Subject Rights and Assistance
Uncloak will assist the Controller in responding to any data subject requests, including access, correction, and deletion requests within required legal timelines.
9. Data Breach Notification
Uncloak will notify the Controller without undue delay if a personal data breach affects the Controller’s data, providing all necessary details and updates as investigation proceeds.
10. Deletion and Return of Data
Upon termination or upon written request from the Controller or Twitch, Uncloak will delete or return all personal data except where retention is legally required.
11. Audit Rights
The Controller may conduct data protection audits upon reasonable notice.
Uncloak will provide documentation reasonably necessary to evidence compliance.
12. Liability and Indemnity
Liability provisions under this DPA align with those stated in the main Terms of Service, subject to applicable data protection law.

This DPA is governed by the same jurisdiction and dispute resolution terms stated in the main Terms of Service (Singapore law).
